Appellant, an employee of Appellee since 1966, was discharged on March 30, 1974. On the date of discharge Appellant was fifty-nine years old. On May 13, 1974, Appellants counsel wrote the Secretary of Labor to notify the Secretary of his intention to file suit on Appellants behalf under the Age Discrimination in Employment Act of 1967 (hereinafter referred to as either "ADEA" or the "Act"). On May 15, 1974, Appellants counsel filed this action in District Court. The District Court concluded that it lacked jurisdiction because of Appellants failure to pursue state administrative remedies prior to filing a federal action. Appellant brings this appeal.
